1. Service Description

Luxenova provides structured media processing and publishing infrastructure that enables users to upload media, enhance content, and publish or export platform-ready outputs through authorized integrations.

The Service may include authentication via third-party platforms, automated formatting, caption generation, draft publishing, and related media workflows.

2. Eligibility

You must be legally capable of entering into binding agreements and have the authority to upload, process, and publish any content submitted through the Service.

You are responsible for ensuring compliance with all applicable platform policies and local laws.

3. User Responsibilities

• You own or have sufficient rights to all content you upload or process through the Service
• Your content does not infringe intellectual property, privacy, publicity, or other legal rights
• You comply with the terms, policies, and community guidelines of any integrated third-party platforms
• You do not use the Service for unlawful, harmful, or abusive purposes

4. Platform Integrations

The Service may integrate with third-party platforms (such as TikTok) through official APIs. Luxenova is not affiliated with, endorsed by, or sponsored by those platforms.

Publishing actions occur only when explicitly initiated by you.

5. Intellectual Property

Luxenova retains all rights, title, and interest in and to the Service, including software, workflows, and underlying infrastructure.

You retain ownership of your uploaded content. By using the Service, you grant Luxenova a limited license to process your content solely for the purpose of providing the Service.

6. Acceptable Use

You agree not to:

• Attempt to reverse engineer, exploit, or disrupt the Service
• Circumvent security or access controls
• Upload malicious code or harmful content
• Use automated systems to overload or abuse infrastructure

7. Suspension and Termination

We may suspend or terminate access to the Service if you violate these Terms or if required for legal, security, or operational reasons.

Termination does not relieve you of obligations incurred prior to termination.

8. Service Availability

The Service is provided on an "as available" basis. We may modify, suspend, or discontinue features at any time to improve performance, security, or reliability.

9. Limitation of Liability

To the maximum extent permitted by law, Luxenova shall not be liable for indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenue, data, or business opportunities arising from your use of the Service.

10. Indemnification

You agree to indemnify and hold harmless Luxenova from claims, damages, liabilities, and expenses arising from your content, misuse of the Service, or violation of these Terms.

11. Changes to These Terms

We may update these Terms from time to time. Continued use of the Service after updates constitutes acceptance of the revised Terms.

12. Governing Law

These Terms are governed by the laws of the Republic of South Africa, without regard to conflict of law principles.
